Garnishment Agent Summary:The Garnishments Agent is responsible for on-going garnishment processes, including set up and maintenance of garnishment vendors, processing and reconciling garnishment deductions and payments to vendors, processing garnishment adjustments, and responding to court inquiries. The Garnishment Agent must be efficient at processing orders and identifying missing information from the garnishment order. Missing information may require conversations with the court or creditor for additional information. Examples include partial social security number, date of birth, home address or other identifying information. FUNCTIONAL GUIDANCE: Conversations with employees by a Garnishment Agent concerning garnishments can sometimes become contentious and when they escalate to the point of being unmanageable supervisor intervention is sometimes required. The Location HR Manager is typically contacted to help resolve the issue and provide a detail explanation to the versations with the creditor s attorneys by a Garnishment Agent concerning a garnishment order can also become contentious and may at times require interpretation. Whenever these discussions escalate to the point of threats of further legal action against the Company supervisor involvement is required. If the issue remains unresolved after further review and research the Legal Department is typically contacted for assistance. AUTHORITY AND RESPONSIBILITY: The Garnishment Agent has discretion involving the timing and method of refunding garnishment amounts that have been deducted in error, or orders that were released after the processing cut-off, but not yet paid to the e discretion is also given to the Garnishment Agent when negotiating a settlement with a creditor s attorney involving an order that has been mishandled. This typically involves garnishment orders that are served at a store location and are not forwarded to the Corporate Office for processing. Any amounts paid by the Company for a Default Judgment, or amounts paid in lieu of a Default Judgment require review with a supervisor at which time a determination is made regarding further involvement by our Legal Department. Communications by the Garnishment Agent with an employee regarding a specific garnishment order are limited to the factual information provided on the garnishment order, including but not limited to, the Plaintiff and Court that issued the order, the amount owed, method of calculation, and duration of the deductions as described in the order. More specific questions received by the Garnishment Agent from an employee concerning a garnishment debt being collected from the employee are without exception referred to the creditor or their attorney.
